Riposte. L’idée évoquée par Patrick Odier, président de l’ASB, de faire signer une déclaration de conformité fiscale aux clients a irrité nombre de ses confrères.
Certains banquiers suisses ne sont pas prêts à faire signer à leurs clients une déclaration attestant qu’ils sont en règle avec leur fisc. C’est le cas d’Ivan Pictet, associé de la banque homographe et président de la Fondation Genève Place financière. Il vient de déclarer dans une interview à la NZZ am Sonntag qu’il était à ses yeux «absolument impensable de contrôler l’honnêteté fiscale du client» sous la forme d’une telle déclaration, s’il n’y a pas de base légale à ce sujet. Des propos a priori en totale contradiction avec ceux tenus le 15 novembre par Patrick Odier, président de l’Association suisse des banquiers (ASB), à ce même journal.
A y regarder de plus près, les deux banquiers privés ne sont pas forcément en opposition frontale. Patrick Odier a évoqué une des pistes possibles pour crédibiliser le projet Rubik d’impôt à la source libératoire; auprès des pays de l’Union européenne (UE) avec lesquels il doit être négocié. Sur le fond, «l’ASB a toujours dit qu’elle recherchait une solution compatible avec l’honnêteté fiscale. Une éventuelle déclaration du client attestant que ses avoirs ont été déclarés et taxés dans son pays n’est qu’un des exem-ples possibles des moyens envisageables pour atteindre ce but de “tax compliance”», rappelle Jean-Marc Félix, responsable de la communication de l’ASB.
Mais l’idée d’une déclaration du client, du fait qu’elle était avancée par le président de l’ASB, a été considérée en Suisse et à l’étranger comme un quasi-acquis... Par ailleurs, ces trois dernières semaines, certains pays de l’UE n’ont guère ménagé la Suisse. En outre, l’UE doit encore trancher, sans doute au premier trimestre 2010 sous présidence espagnole, la délicate question de savoir si elle veut essayer d’imposer aux pays tiers, comme la Suisse ou le Liechtenstein, l’échange automatique d’informations; pour que le Luxembourg et l’Autriche acceptent de s’y rallier. Ou si elle va d’abord tenter de l’obtenir de ces deux pays qui font exception en son sein en pratiquant, tout comme la Suisse, la retenue à la source dans le cadre de la directive sur la fiscalité de l’épargne. A ce sujet, Michel Dérobert, secrétaire général de l’Association des banquiers privés suisses, ne se fait guère d’illusions: «L’UE, avant de tenter de forcer un pays membre à changer sa pratique, pourrait bien s’attaquer en même temps aux pays tiers.» En clair, il s’attend, comme la majorité des banquiers, à ce que les pressions sur le secret bancaire ne faiblissent pas.
Dans ce contexte, le rôle du président de l’ASB est de définir une stratégie visant à régulariser le passé pour éviter que les clients européens de longue date ne soient en délicatesse avec leur fisc national, de trouver une solution pour le futur préservant la sphère privée - c’est le rôle de Rubik - et d’obtenir l’accès au marché. Sans oublier de définir une vision commune avec le Conseil fédéral: le secteur bancaire n’étant pas la seule préoccupation de Berne qui doit aussi se soucier de l’avenir des relations avec les Etats-Unis ou l’UE des autres branches de l’économie.
En tant que président de Genève Place financière et banquier privé, Ivan Pictet n’est pas contraint par l’exigence de concilier les intérêts parfois divergents des différents types de banques actives en Suisse. Il peut jouer le rôle de celui qui rétorque fermement aux menaces venant de l’extérieur et tente de rassurer les clients. En suggérant par exemple, dans la même interview, à la Finma et à l’administration fédérale des impôts d’accepter des trusts de droit étranger sur le modèle de ceux que reconnaît le Royaume-Uni. Or, précise Michel Dérobert, «si la Grande-Bretagne affirme pouvoir identifier les ayants droit de trusts de droit britannique, elle ne dit pas qu’elle peut aussi le faire pour les trusts de droit étranger». De quoi rendre peu opérant l’échange automatique d’informations. Pour cet expert, il est important «que la Suisse n’invente pas des solutions qu’elle serait seule à appliquer». Quant à évaluer les chances de Rubik... «Il va y avoir une confrontation entre les gens réalistes à l’intérieur de l’UE, qui veulent faire entrer de l’argent dans les caisses, et les dogmatiques, qui veulent gagner sur des principes, même si ça leur rapporte beaucoup moins.»

We have recently been informed that due to pressure from our M.P. that the Ministry of Justice had asked Lord Myners to investigate our claims that the F.S.A. covered up the illegal activities of Pictet Asset Management. London. They might as well have asked Ivan Pictet to investigate .or Friends Reunited.

The consensus of opinion is the Pictet & Cie should be prosecuted , and that their banking licence’s should be taken away in the U.K. ( and fined.) Their solicitors at Peters & Peters --- struck off and prosecuted.. In America they would have all been in prison for the last seven years.

The bank and it’s officials/lawyers deliberately withheld crucial documents requested under a High Court order. The bank and it’s officials/lawyers deliberately withheld evidence from the Police, and one of it’s account managers Susan Broadhead gave a false witness statement . Another one of it’s managers Nicholas Campiche ( Now Head of Pictet – Alternative Investments.) concocted a letter pretending to be a client and closed his account. The senior partner (Ivan Pictet.) sought to have numerous documents destroyed,along with those copies held in their London office’s of Pictet Asset Management. Initially stating that they were forgeries then their lawyers Peters & Peters – Monty Raphael –and the barrister Charles Flint.Q.C. later had to admit in Court that the documents were genuine.

(3) A bank can be guilty of Contempt of Court if it fails to comply fully with the Courts order for discovery .

In the F.S.A. cover up , they concluded that there had been “ Rogue” elements in Pictet & Cie’s , London operations . They had been moved from their London Office so who was there left to prosecute. “ Unbelievable.”

We started our campaign in June 2008 -- via the “net” to highlight our fight to get “justice”. In our second year campaign we hoped to reveal further damning evidence .
